PA Senate prepares to give Gov. Wolf legislation to reopen businesses

According to the social media accounts of Senator Gene Yaw· within the past hour,  “The #PASenate plans to return to Session this week to send legislation to the Governor’s desk that will put forth a fair, safe and responsible process to re-open businesses across our Commonwealth.”

Monday evening Governor Wolf gave an address to all Pennsylvanians; the primary subject was to thank Pennsylvanians for sacrifices during the 2019 novel coronavirus pandemic.

Earlier in the day Governor Wolf garnered a victory when the Supreme Court of Pennsylvania issued an Opinion upholding the non-essential business closure Order.

From the Concurring and Dissenting Opinion authored by Chief Justice Saylor: Within the Brief for Petitioners at 48 (footnote omitted). 2 The majority observes that the General Assembly has the ability to terminate the Governor’s order. See Majority Opinion, slip op.at 37 (citing 35 Pa.C.S. §7301(c)). Although I agree with the majority that this serves as one check on executive power, I note that the Constitution serves as another.

Monday evening, a joint statement was issued by Senate President Pro Tempore Joe Scarnati (R-25) and Senate Majority Leader Jake Corman (R-34) announcing the Senate plans to return to session this week to consider legislation that will provide a safe path for re-opening the state’s economy.

“The Senate plans to return to Session this week to adopt legislation that will put forth a fair and responsible process to re-open businesses across our Commonwealth.

“Throughout the COVID-19 public health emergency we have endeavored to work together in a bi-partisan manner to do what is in the best interest of our Commonwealth.  Unfortunately, it has become abundantly clear that the Governor’s waiver process for employers to remain open during this time has been extremely flawed and lacks transparency.” 

“We must keep our communities safe while also helping workers get back to their jobs. The decisions of how to successfully implement plans to re-open our economy will rest with the legislature of Pennsylvania and not with liberal governors from other states.”
