BREAKING NEWS: Felony counts against former WBP Officer dismissed

On Wednesday, Senior Magistrate Judge Allen Page dismissed the most serious felony counts of (Unlawful Use of Computer – Access to Disrupt Function 18 § 7611 §§ A1) against former Williamsport Bureau of Police officer Eric Derr in a case brought by the PA Attorney General.

The misdemeanor count of Unsworn Falsification to Authorities (18 § 4904 §§ A1 M2 ), Tamper With Public Record/information (18 § 4911 §§ A1 M2) and (18 § 5101 M2) Obstruct Admin Law/Other Govt Function were held for Court.

The count of Coerce/Threat Of Official Act (18 § 2906 §§ A4 M2), Hinder Apprehension/Prosecution-Conceal/Destroy Evidence (18 § 5105 §§ A3 M2) and Official Oppression-Arrest Search (18 § 5301 §§ 1 M2) were withdrawn.

Formal arraignment on the remaining counts is scheduled to be hearing before Lycoming County Senior Common Pleas Court Judge, Nancy Butts on February 22 at 8:30 a.m. in Courtroom 1.

Did a former local Police Chief encourage and condone the car bombing of this author with an online post?

Former Williamsport Bureau of Police Assistant Chief and former Sunbury Police Chief Tim Miller took to Facebook in the days after this series began and weighed in.

“A men Ricky. This asshat who did this story has no clue. 18 months to sling mud at everyone in Lycoming County who ever played baseball.

I certainly hope and I have spoke to a few

who fully intend to hold the author accountable for his ill informed accusations.

There is a big difference between a fact and a supposition.  This ass hat has given a new twist to an abuse of freedom of the press.

Just when I thought I have seen it all this bozo leads everyone to the muddy water though.

Spoke to numerous people who see through this smoke.

Something absolutely happened but was it shenanigans or some sexcapade like this guy eludes to.

WAHS dropped the ball. Should have fired a few people and kicked a few off the team but damn we got a full fledged COVERUP in the home of the little league baseball.

Why not wait till little league World Series next year to drop this 18 month long witch hunt.

Ricky Stryker is a long time and well know associate of Darrick Dixon and was previously referenced in this series for making threats after PART VIII and PART IX.

When former Williamsport Bureau of Police Assistant Chief and former Sunbury Police Chief Tim Miller states:

Could the typed and published words of Miller cause him to have criminal and civil liability?

With the Impeachment trial of former President Trump happening today and those involved involved in storming the U.S. Capitol building being criminally charged; the answer may be, yes.

 

Former law enforcement member Tim Miller confirms the reporting in this series when he unequivocally states:

Has Tim Miller ever bothered to call the Myrtle Beach Police Department out of an abundance of caution or concern?

Or maybe from a place of moral authority?

The answer is a resounding, No.

In his official law enforcement capacity did Tim Miller fail to report a crime of a sexual nature against a child?

In his online message he claims to have intimate knowledge of what occurred and yet has not made the call.

 

As Miller puts it “Something absolutely happened but was it shenanigans or some sexcapade like this guy eludes to”. The behavior has been confirmed to be “criminal sexual misconduct”, by Lycoming County District Attorney Ryan Gardner.

Gardner subsequently referred the case to Pennsylvania Attorney General Josh Shapiro.

Tim Miller went onto say in his statement, “WAHS dropped the ball. Should have fired a few people and kicked a few off the team but damn we got a full fledged COVERUP in the home of the little league baseball.”

This author has confirmed throughout this series that Pennsylvania Attorney General Josh Shapiro and his team are fully investigating the matter.

 

Tim Miller was the Sunbury Police Chief at the time of the Myrtle Beach trip in 2018 and resigned in July 2018 as reported by WNEP-TV.

SUNBURY, Pa. — “A city in Northumberland County is looking for a new police chief. Tim Miller resigned as Sunbury’s chief Monday night.

Even though he won’t be chief anymore, he will be on the city payroll until next spring.

According to Sunbury’s solicitor, Chief Tim Miller had a non-disclosure contract in place signed by the chief and city officials. The solicitor would not give the specifics of Miller’s medical condition or the contract, but Miller has been put on paid administrative leave until April 2019.”

The WNEP story concludes, “Former Chief Tim Miller did not return our phone call for comment but has told city officials that he is enrolled in barber school.”

 

Hostility and Tim Miller have gone hand-in-hand for sometime as his co-workers noted when he was assistant chief in the Williamsport Bureau of Police and described in detail in a federal lawsuit filed by Lieutenant Steven Helm.

WILLIAMSPORT — “Sunbury police Chief Tim Miller has been named in a federal lawsuit after a former co-worker filed an 18-page complaint claiming he had to deal with a hostile environment while working in the Williamsport Police Department, according to court documents. Lt. Steven Helm claims his civil rights were violated while working under Miller, who was the assistant Williamsport chief at the time.”

 

According to PennLive on Jul 22, 2019, “Williamsport settles for $185,000 three federal lawsuits brought by police officers”

WILLIAMSPORT – The city of Williamsport through its former insurance carrier has paid $185,000 to settle three federal civil rights suits brought by two police officers alleging anti-union bias.

Two suits brought by Lt. Steven Helm, president of Fraternal Order of Police Lodge 29, were settled for a total of $150,000 and the one of Lt. Fred L. Miller IV for $35,000.

Helm received $93,197 and Miller $22,830, with the rest going to the law firm of Schemery Zicolello that represented both officers.

Confidentiality agreements prohibit the parties from commenting but attorney Michael Zicolello posted this on Facebook:

“We feel many wrongs were righted as a result of Helm’s several years-long lawsuit.”

Helm’s first suit, filed in April 2017, was against the city, now retired Chief Gregory Foresman, former Assistant Chief Timothy S. Miller and Young.

In that complaint, Helm claimed he was subjected to retaliation for raising issues within the department and for his wife Shelley being an on-line public critic of the department’s leadership.

One federal lawsuit involving police remains. Former assistant chief Miller in 2017 sued the city, Helm, the FOP lodge, Councilwoman Elizabeth Miele and former Council President William Hall.

He is seeking unspecified damages for retaliation, due process violations, conspiracy, defamation and release of private personal information.

 

Tim Miller has also been a very outspoken proponent of Darrick Dixon providing a ringing video endorsement.

On Sep 20, 2012 then WBP Lieutenant Miller recorded a video behind City Hall and in front of the Police Station.

He resoundingly endorses Dixon.

At the :54 second mark of the video, then Williamsport Area High School Principal Tim Fausnaught is also seen and heard endorsing Darrick Dixon as “making sure people see him (Dixon) as a positive role model.”

Carol Fausnaught, President of the Board of Dwell Orphan Care is the sister-in-law of Tim Fausnaught.

Jennifer Lake is the Founder and Executive Director of Dwell Orphan Care. Lake is also a current member of the WASD School Board.

As recently as last night, a person posing under the name “John Hamm” responded to the question posted in the comment section of the Webb Weekly Live broadcast of Loyalsock verses Montoursville; “who is behind the camera tonight?” with the following:

“every time someone talks s**t……

s**t happens….don’t they get the point?

Do these statements amount to a confession of previous criminal acts perpetrated against this author?

Crosscutters Unveil Schedule for Inaugural MLB Draft League Season

The Williamsport Crosscutters in conjunction with Major League Baseball have announced the 2021 schedule for the all-new MLB Draft League. The league will be the first in the country focused on top prospects eligible to be drafted during the season while giving them the unique opportunity to showcase their abilities and gain exposure to MLB Clubs and fans each year.

The Williamsport Crosscutters are joined by the Trenton Thunder (formerly of the Double-A Eastern League) and Frederick Keys (formerly of the Class-A Carolina League) along with the Mahoning Valley Scrappers, State College Spikes and West Virginia Black Bears (all formerly of the New York-Penn League) as founding members of the MLB Draft League.

The 6-team league will play a 68-game regular season (34 home & 34 away) that begins May 24 and concludes August 13 with a break in mid-July for the MLB All-Star Game and Draft. The top two teams will qualify for the league championship in a winner take-all game.

Congressman Keller named Ranking Member of Education and Labor Subcommittee on Workforce Protections

Washington, D.C. – Today, Congressman Keller (R-PA) announced he will serve as Republican Leader of the Subcommittee on Workforce Protections, one of five subcommittees within the Education and Labor Committee.

Department Failed to Advertise Amendment for Child Sex Abuse Survivors
Pennsylvania State Senate Majority Leader Kim Ward offered the following statement on the resignation of Secretary of State Kathleen Boockvar.
Harrisburg – “It is disgraceful that Pennsylvania Secretary of State, Kathy Boockvar, failed in her constitutional duty to advertise a proposed constitutional amendment for child sex abuse victims. Her dereliction of duty has failed these victims, failed voters who would have had a voice this spring, and failed the Commonwealth.
This disastrous scenario demands a full investigation. I will be asking our members to conduct their own hearings to determine how this could have happened. Kathy Boockvar’s resignation does not absolve her of the legal responsibilities she possessed.
The Senate is committed to working with the House of Representatives to ensure a path forward continues. Sadly, the work of so many people on such an important issue has now been derailed by incompetence”.

Corman: Boockvar’s Ineptness is a Failure for Survivors of Child Sex Abuse

Senate President Pro Tempore Jake Corman (R-34) issued the following statement on Governor Wolf’s announcement that Secretary of State Kathy Boockvar will resign after failing to property advertise a constitutional amendment that was to help victims of child sex abuse:
“I have been saying for a long time that Secretary of State Kathy Boockvar’s ineptness has been detrimental to Pennsylvania. This is just one in a series of disasters throughout her tenure. This time, Secretary Boockvar has failed the survivors of child sex abuse and disregarded the will of the people. At best, this was incompetence. At worst, this was malfeasance.
“By mismanaging a simple – but constitutionally significant – advertising requirement, Secretary Boockvar once again put on full display that she is incapable of reading the Constitution and implementing Pennsylvania law. From the beginning we maintained that the only way to ensure justice for these victims was to amend the PA Constitution. Having thought the opportunity to achieve this justice was in sight as the General Assembly was poised to pass the proposed amendment for the second time, the survivors will now be revictimized by having to wait an additional two years due to the incompetence of Secretary Boockvar.
“Senate Republican leaders were vilified and dragged through the mud for months when we were trying to create a real solution for victims that would withstand legal scrutiny instead of passing the measure as a bill. Now, as we see Secretary Boockvar fail to do even the simplest and most basic task to help Pennsylvanians who have been victimized, we see exactly how little this administration actually cared.
It was never about people; it was always just about politics.”

Senator Doug Mastriano weighs in on reports of Sec. Boockvar resignation

Pennsylvania State Senator Doug Mastriano weighed in Monday afternoon regarding media reports of the impending resignation of Secretary of State Kathleen Boockvar.
“One of the most important roles I have as a State Senator is reviewing the Governor’s selections for state cabinet positions, and confirming their appointments.
Competence is vital.
I was a “no” vote when State Department Secretary Kathy Boockvar was confirmed by the Senate in November of 2019.
Various news sources are reporting that Boockvar – who oversees elections in PA – is resigning, due to a recent error.
Unfortunately, incompetence was prevalent during her tenure.
On at least four occasions, I expressed my concerns about election security and specifically asked how she would address the issue.
I never received a satisfactory answer.
As a result of those deficiencies…among others…I have been calling for her resignation since November.
Pennsylvanians deserve a fair electoral process, where they are assured that every legal vote counts.
It is my hope that our next State Department Secretary possesses the leadership qualities that are necessary to restore confidence in our elections.”

PA Senate Democrats Introduce legislation to get justice for adult victims of childhood sexual abuse

(Harrisburg, Pa.) — Pennsylvania Senate Democrats will introduce legislation to statutorily create a two-year window for survivors of sexual abuse to seek justice on claims that previously would have been time barred.

This legislative solution is intended to replace the constitutional amendment process, which has been inadvertently voided by the Department of State. To amend Pennsylvania’s constitution, a bill must pass in identical form in two consecutive legislative sessions. After each passage, the bill must be advertised and after the second passage, it goes to voters for their approval.

A constitutional amendment to open the two-year window for sexual abuse survivors passed in the previous session, but the Department of State failed to advertise it and thus the lengthy process would have to start over again.

The Senate Democrats do not believe that survivors should have to wait any longer for justice. Statutory windows to justice have been upheld constitutionally in other states, and the caucus believes that it is acceptable and necessary here in Pennsylvania.

“This is a disappointing setback in the process to create the window to justice,” said Senate Democratic Leader Jay Costa, Jr. “If we continue with the constitutional amendment process, it will be at least another 2 years until the window would be created and that’s simply too long. A legislative solution can create the window immediately, and I’m encouraging bipartisan and bicameral support for the bill that members of our caucus is going to introduce. Survivors need justice now.”

Senators Maria Collett, Katie Muth, Lindsey Williams, and Steve Santarsiero and Tim Kearney will be introducing the bill immediately and have been champions for survivors of sexual assault since they were each elected in 2018.

“To say I am disappointed by this setback is an understatement,” said Senator Collett. “I am devastated on behalf of the victims of childhood sex abuse in my district and across the Commonwealth who have shared with us their heartbreaking stories and entrusted us to bring them long-overdue justice and path to healing. The last thing these victims need is another delay, another slight that makes them feel like no one cares about their pain. Regardless of our politics, religion, age or gender, we all know that the institutions whose failures led to these victims’ trauma need to be held accountable. The legislation my colleagues and I are introducing will correct the mistake made by the Department of State and bring victims across Pennsylvania one step closer to justice.”

“Legislative action is long overdue and with this latest delay waiting another two years is simply unacceptable,” said Senator Muth. “The General Assembly needs to pass a statutory window as soon as possible and finally allow justice and healing for these victims.”

“The time for debating has long passed,” said Senator Santarsiero. “There is no need to amend our State Constitution.  The General Assembly has the authority to pass the two-year window to give the victims of child sex abuse what they have long sought and what they so dearly deserve:  justice.”

“Victims cannot wait any longer for justice,” said Senator Williams. “We need to pass a statutory window immediately.”

“We led the fight last session to reform Pennsylvania’s statute of limitations, and we will not let up now,” said Senator Kearney. “The process of a constitutional amendment was unnecessary in the first place. Survivors have waited long enough for justice, and they shouldn’t have to wait another two years because of an administrative mistake. We must pass this bill now, because justice delayed is justice denied.”

On behalf of these survivors, the Senate Democrats ask for a swift passage of the new bill and the Governor’s commitment to make its passage a priority.

Top Pa. election official to resign after agency bungled requirement for constitutional amendment

HARRISBURG — Pennsylvania’s top election official is expected to resign her position after her agency’s staff discovered a mistake that will block voters from deciding this spring whether to allow survivors of decades-old sexual abuse to sue the perpetrators, according to three sources familiar with the matter.

The Department of State did not advertise, as required, a proposed amendment to the state constitution that would open a two-year window for litigation by survivors of child sexual abuse who have aged out of the statute of limitations for suing. Kathy Boockvar has led the agency since 2019, and oversaw a tense and difficult presidential election in a battleground state last year.

The change was a key recommendation in a blistering 2018 report by a statewide grand jury that investigated the coverup of decades of child sexual abuse in the Catholic Church. It is backed by the state’s community of survivors, who have been pushing for the change for nearly two decades.

The mistake means that the earliest voters can decide whether to create a two-year window is spring of 2023.

Boockvar declined to comment, and a spokesperson also did not return a call. A spokesperson for Democratic Gov. Tom Wolf, who nominated Boockvar to the $145,244 a year position, did not return a call seeking comment.

Under state law, changes to the state constitution require that a proposal be approved by the legislature in two consecutive sessions. At that point, the proposed change appears on the ballot for voters to decide.

The two-year window in the statute of limitations was first approved in the legislature’s 2019-20 session. It was just approved again last month by the House of Representatives and is expected to soon pass the Senate. The goal was to place the question on the spring primary ballot.

Before the question can appear on the ballot, however, Boockvar’s agency is required to advertise the change both times it is approved. Administration officials discovered last week that the Department of State, which oversees elections, did not advertise the proposed ballot question when it was approved in the 2019-20 session.

That means the process has to begin anew, with the legislature approving in the current, 2021-22 session, and again in the 2023-24 session.

Lycoming County Republican Committee rebukes Sen. Toomey in letter

This morning Vince Matteo, Chairman of the Lycoming County Republican Committee made public a letter he sent to Pennsylvania Senator Pat Toomey.

Toomey previously announced he is not seeking Senate re-election or interest in running for Governor.

Matteo shared the following on social media moments ago.

“At our meeting of January 14th, the members of the Lycoming County Republican Committee present voted unanimously to send a letter to Senator Pat Toomey expressing our strong disappointment and concern that he would call on President Trump to resign without any due process. I sent the following letter to the Senator on January 18th and emailed it on January 19th. I am making the letter public now because enough time has past and he should have seen it by now and while I have not heard from the Senator, I did hear from a staff member that the email was received (It was not an automatically generated reply). Dear Senator Toomey:

I am writing on behalf of the members of the Lycoming County Republican Committee. At our meeting of January 14, 2021 the members present voted unanimously to express to you our sincere disappointment and concern in your call for President Donald Trump to resign following the horrible action taken by rioters at the Capitol Building. We firmly believe your actions were not in the best interests of Pennsylvania or the United States. It was also not in the best interests of bringing our nation together.

We were further dismayed that you would run to CNN;  the network that spent four years continually undermining the President and pushing the false Russian collusion narrative. This betrayal by you is unexplainable and inexcusable and, quite frankly, had an air of “revenge” unbecoming your office. While it is clear you never fully supported President Trump, we expect more from our Senator.

Finally, you now claim if an  Impeachment trial is held you will review the evidence to determine how you will vote. It is hard to believe that you could judge fairly since you already played judge and jury when you called on President Trump to resign. Your obvious bias against the President may have disqualified you in the Impeachment trial.

Senator, you owe President Trump and the people of Pennsylvania an apology.
