The following is an opinion editorial authored by Todd Bartley, TalkWilliamsport.com, News@TalkWilliamsport.com.

While he was a councilman, Derek Slaughter asked a now infamous question during a city council meeting to Bill Nichols, then city finance director and manager of River Valley Transit “where are the numbers?”

At which point, Nichols replied, “sounds like a platform to me.”

Echoing the same refrain four years later; now as Mayor, Slaughter still cannot come up with the numbers.

When asked by city council what the current financial state of the city is, Slaughter answered, “with the audits still going on we don’t know what funds are there and what funds are not, we just don’t know.” 

Now, Mayor Slaughter has had to close City Hall after the codes department condemned the building.

So if Mayor Slaughter has no idea what the numbers are or where the numbers come from; is it any wonder city departments are scattered throughout the City of Williamsport under multiple leases with any number of landlords?

HE HAS NO PLAN!

In fact, there was never a plan.

After City Hall closed, City Council asked months ago for Mayor Slaughter to provide them with a plan on costs to repair and/or renovate the building.

To date, Mayor Slaughter has yet to provide the plan.

On reason, belief and the actions of Mayor Slaughter; there is never going to be a plan – since he has no intention of ever going back to City Hall.

How is that conclusion drawn?

During a mayoral candidate forum years back Slaughter was asked about staying or leaving city hall; (paraphrase) “there is no reason to put anymore money into that building.”

In the early days of him taking office as Mayor he was invited to tour any number of buildings owned by Lycoming County; as the county looked at reducing its footprint and realizing more economies of scale with a shrinking population.

Slaughter toured Executive Plaza (current home of numerous Lycoming County Offices), as well as Third Street Plaza (TSP) most notably the home of Lycoming County Voter Services and the Lycoming County Emergency Operations Center (EOC).

Lycoming County and the City of Williamsport have an agreement in place to swap nearly equal sized parcels in order for the county to be able to more easily sell Executive Plaza.

The real estate closing has yet to take place and according to those close to the transaction – “it is puzzling why this deal has not closed yet.”

Based on a pre-covid-19 study done by local government officials the needed office space to accommodate the entire City of Williamsport government would be 10,000 square feet or less.

That number did not include the Williamsport Bureau of Police.

So here is the plan after Mayor Slaughter wasted hundreds of thousands of dollars on a handicap ramp to nowhere in front of City Hall.

Slaughter and his administration are most likely facing a ruling from Federal Judge Brann in favor of the Center for Independent Living; finding the City of Williamsport in contempt of a court order since City Hall remains closed.

Third Street Plaza is already ADA compliant.

The City of Williamsport should enter into an inter-governmental lease agreement with Lycoming County for 10,000 square feet or less of space on the 4th Floor of Third Street Plaza.

This amount of space is less than half the available space on the 4th floor. The remaining space on the 4th floor could be leased by the Williamsport Bureau of Police as offices and records storage.

The space is move-in ready as of April 1, 2022.

The 4th floor is accessible via elevator and could easily be secured since the Williamsport Bureau of Police could also locate on the first floor of the building with a security office or on-duty desk in the former bank location.

A portion of the bank space could be sectioned off for the City finance department and possibly co-locate with Lycoming County central collections department and make use of the drive-thru for citizens to pay taxes and fines.

This would cut down on the foot traffic into the courthouse.

With the Third Street Parking Deck steps away, the City Police Department could have its vehicles in a controlled environment with video surveillance as well.

The TSP and Third Street Parking Deck locations potentially provide even quicker response times for the Bureau of Police.

If Lycoming County also moved the Commissioners Offices and public meeting room into Third Street Plaza; multiple public meeting rooms could be wired for live video streaming; creating tremendous leverage for both County and City governments.

City Council would be able to have working committee meetings and simultaneously the County Commissioners could hold their public meetings as well.

As an example, in case of a flooding event; the gathered leadership can easily meet in the EOC and then come to the public meeting rooms and deliver real time information to the public.

This was first suggested by this author nearly a decade ago related to the launch of local government and education channel 75.

If the City of Williamsport is unwilling to spend between $6 million and $20 million dollars to bring City Hall to code; it would take a minimum of 6 years to hit that number by leasing space in Third Street Plaza.

As Covid-19 demonstrated with all of the remote meetings; government entities are shrinking their footprints.

The synergies that can be realized with a move like this are tremendous; instead of having multiple departments in separate buildings and multiple leases, this plan eliminates that need and consolidates the functions of city government.

Going forward, as the closing on the existing deal for Executive Plaza and the City of Williamsport whole of government moves into Third Street Plaza, all I ask is attribution to this article when it occurs.

Even college professors understand lack of attribution and plagiarism are frowned upon.

This is what actual, “Transparency, Efficiency and Accountability” in “good government” really look like.

Earlier today, Attorney Gregory A. Stapp, Esquire of Stapp Law, LLC notified Pennsylvania Attorney General Josh Shapiro of his intention to pursue civil litigation against him and the Commonwealth of Pennsylvania on behalf of JOHN DOE#1 in the  2018 Williamsport Area High School baseball “criminal sexual misconduct” case.

Stapp also served a letter on Fred Holland, Williamsport Area School District Solicitor who has previously characterized the case as “indecent and inappropriate behavior.”

Holland represents the Williamsport Area School District including Superintendent Dr. Tim Bowers.

Bowers was heard on a hot microphone speaking to another WASD school board member at the most recent school board meeting when told that board member had retained legal counsel related to this case; “nothing will ever happen with that.”

Another letter was provided to the City of Williamsport as well as a letter to the Lycoming County Commissioners; since the Office of District Attorney falls under their legal purview.

Dear Sir/Madam:

The purpose of this letter is to provide you with notice pursuant to 42 Pa.C.S.A. §5522 that REDACTED, REDACTED, and JOHN DOE#1, located at REDACTED intends to make a claim against multiple Commonwealth agencies for failure to report and properly handle the indecent assault, harassment and intimidation of JOHN DOE#1 that took place in Myrtle Beach, South Carolina while on the Williamsport High School baseball trip in March of 2018. This cause of action will be against the Commonwealth of Pennsylvania, Williamsport Area School District, Lycoming County, Williamsport City Police (City of Williamsport) and other defendants, including, but not limited to, employees and agents of each of these various governmental agencies.

JOHN DOE#1 was assaulted by PERPETRATOR #1 at the Atlantica Resort while other members of the baseball team were present, one of which videotaped the assault (VIDEOGRAPHER #1) and posted the video on social media. There were five coaches with the baseball team on this trip.

Brandon Pardoe, Williamsport High School Principal, and Sean McCann, the Athletic Director, were also on the trip. One of the five coaches, Nick Caringi, a volunteer coach, was an employee of Little League Baseball Incorporated at the time of the assault. All the above individuals were mandated reporters under the Child Protective Services Law, 23 Pa.C.S.A. §6311. Despite this fact, none of these individuals reported the assault on JOHN DOE#1, either while in Myrtle Beach, South Carolina or when they returned to Williamsport.

Editor’s Note: Ryan Miller, WAHS head baseball coach, and assistant coaches, David Heller, Tariq Moore, Kyle Schneider and Joel Worthington were the five other coaches in addition to Caringi, that accompanied the WAHS baseball team on the 2018 trip.

Over the course of the months following this incident, each of the agencies involved participated in an effort to cover up the assault on JOHN DOE#1. The assault was initially reported by an individual who was not on the trip to Myrtle Beach with the team or affiliated with Williamsport Area School District. When the referral of this matter was finally made to Childline, the matter was referred to the Lycoming County District Attorney’s Office.

Acting District Attorney, Ken Osokow, referred this matter to Chief County Detective William Weber. Despite the fact that a meeting was held with JOHN DOE#1 at Brandon Pardoe’s office in May 2018, the Resource Officers at Williamsport Area School District, such as Officer Stoltzfus, told officers in Myrtle Beach that they had no knowledge of the incident in October 2018. Officer Stoltzfus is an employee of the Williamsport City Police Department.

As a direct and proximate result of the assault, harassment and intimidation of JOHN DOE#1, and the subsequent attempts to cover up the assault, JOHN DOE#1 has suffered numerous damages.

Should you have any questions regarding this claim, please direct them to my attention. This letter will serve as notice that a copy has been served upon Lycoming County, Williamsport Area School District, and the City of Williamsport.

“I echo everything the Secretary (Miller) just said. I would just add. There are no higher priorities than protecting the most vulnerable in our state and children often times are the most vulnerable and when we find folks who are mandated reporters who are covering up abuse, we will hold them accountable.

We’ve charged many people, with, for example endangering the welfare of children.

We will not hesitate to charge mandated reporters who think they can cover-up abuse going on in a particular situation; whether a school, a place of worship, a school bus, whatever the case may be. And I think our record speaks for itself on that.”

Last night at the regularly scheduled WASD school board meeting, an agenda item to “Consider ratifying the appointment of Scott R. Williams to the Board seat formerly held by Star Poole which was declared vacant at the meeting that occurred on January 4, 2022″ was voted on.

At this writing, all previous meeting agendas other than 1-18-22, no longer appear on the WASD website.

Williams was voted onto the board by a 5-3 vote. Voting “Yes” were, Lori Baer, President, Barbara Reeves, Vice President, Patrick Dixon, Jennifer Lake and Jamie Sanders.

Voting “No” were, Michelle Deavor, Cody Derr and Adam Welteroth.

Prior to taking his seat on the Williamsport Area High School Auditorium stage, Scott R. Williams presented Lori Baer, President, with an “Oath of Office” document.

In a brief phone interview this afternoon, Scott R. Williams confirmed he was sworn in by “Judge Christian Frey”.

TalkWilliamsport.com exclusively obtained the “Oath of Office” document Scott Williams – Oath of Office – January 2022 through a Pennsylvania Right-to-Know Law Request to WASD Right-to-Know Law Officer and Board Secretary Wanda Erb, made this afternoon.

Soon after the RTKL request was made, Erb provided the “Oath of Office” document.

The document reveals, Scott R. Williams took an Oath of Office at 3:30 p.m. on January 10th. The Oath of Office was administered by Lycoming County Magisterial District Judge Christian Frey.

A message was left for Lycoming County Magisterial District Judge Christian Frey this afternoon; at this writing it has not been responded too.

Earlier in the day yesterday, Attorney Greg Stapp sent an e-mail to WASD Solicitor Fred Holland (who did not attend the meeting last night) alleging “the WASD School Board violated the Sunshine Act and their own Policy in a recent meeting.”

The e-mail went unanswered until today, when Holland responded to Attorney Stapp with an explanation of the process the WASD school board had undertaken.

TalkWilliamsport.com has reached out to Attorney Greg Stapp for comment and potential next steps for his client, he reserved comment pending a conversation with his client.

TalkWilliamsport.com also reached out to Lycoming County District Attorney Ryan Gardner for an update on the petition filed by Williamsport resident Sheri Crain seeking to remove the entire WASD school board for “malfeasance in office” as well as “dereliction of duty.”

At this writing, Gardner has not yet responded.

Yet, Lake as Executive Director of Dwell Orphan Care sat on a war chest of six figure resources that could easily be dispersed to assist a family in need – yet on reason and belief – she did nothing to address the situation.

Lake states: “everyone can do something for the cause of caring for kids from hard places.”; but her vanity got in the way again, those funds are reserved for “foster and adoptive families.”

Was it mentioned Star Poole is black and Jennifer Lake is white?

As Star Poole struggled, the “unarmed truth” is Jennifer Lake in 2020 brought home a salary of $37,095 which is 144% of the 2020 total of $25,719, Dwell Orphan Care claims it provided to help support Foster and Adoptive Families in the Greater Lycoming County Area.

Indeed, Jennifer Lake has told the world where she stands on the “Black Lives Matter” movement and all things “WASD Systemic Racism” and the “Racism has No Home Here” movement.

Her “excessive pride in or admiration of one’s own appearance or achievements” on these topics include volunteering to read into the record at a WASD school board meeting a mere 28 days after the tragic death of George Floyd – WASD School Board Adopts Anti-Racist Resolution.

Dear Fred,

I have been asked by Michele Hazel to reach out to you regarding the Williamsport School Board’s recent meeting in which they tried to appoint a member of the community to the School Board without having the appointment or a discussion of the vacancy on the agenda.  It is my understanding that Williamsport Area School District has a Board Policy on how to fill vacancies on the Board.  It would appear that the Board violated the Sunshine Act and their own Policy at their recent meeting.  In light of Star Poole’s due process hearing, which took several meetings, it appears that the Board is trying to fill her vacancy in one meeting.

The purpose of this email is to request that the Williamsport School Board immediately open the board position for applications and allow individuals, like Michele, to apply for the School Board along with any other qualified candidates over the next ten days, or until January 28^th.  It is my further understanding that there will be a school board meeting on February 1, 2022, at which time the applicant’s names could be placed on the agenda and discussed at the meeting in accordance with Board Policy and the Sunshine Act.  This would afford applicants, like Mrs. Hazel, an opportunity to address the board and the number of write-in votes that she received in the last election in an effort to fulfill the School Code which provides a model of government that resembles our representative republic.

Washington, D.C. — Today, Congressman Fred Keller (PA-12) released the following statement in response to the Supreme Court’s decision halting Biden’s vaccine mandate on businesses with more than 100 employees:

“The U.S. Supreme Court ruled 6-3 to stop President Biden from implementing his authoritarian vaccine mandate on American workers. This is the outcome we expected—with the Court asserting that President Biden lacks the constitutional authority to unilaterally dictate federal law.

While the case now returns to the lower courts, I will continue my efforts to permanently eliminate this unconstitutional mandate under the Congressional Review Act (CRA). Our CRA resolution has the unanimous support of the entire House Republican Conference, and our team has held productive conversations with House Democrats who recognize how disastrous President Biden’s mandate would be if enacted.

I am hopeful that this ruling will inspire more House Democrats to join us to force a vote on the Floor and eliminate this egregious mandate once and for all.”

On Tuesday evening the Williamsport Area School District School Board held their first meeting of 2022. Prior to the regularly scheduled meeting a “due process hearing” was held in “executive session” or “in private”; according to the publicly posted meeting agenda “for Star Poole.”

The agenda makes no mention of the purpose of the “due process hearing”.

That information was noted in the Board Agenda from December 7, 2021.

4.1 BOARD PRESIDENT’S REPORT –

A. Consider whether to set a date for a due process hearing to remove Star Poole

from her position as a Board member.

Previously when given the opportunity to second a motion to begin a discussion on a third party investigation into the WASD handling of the 2018 WAHS baseball/Myrtle Beach case; Poole sat silent.

A black WAHS baseball player was “criminally sexually assaulted” by a white teammate on the trip.

The white teammate was criminally charged in South Carolina last year.

Prior to the vote being taken, WASD school board member, Mrs. Cody Derr stated “She (Star Poole) has missed 13 meetings since I got here last year. That’s half the meetings.”

Mr. Jamie Sanders, added there were at least three occasions where; “She (Star Poole) missed 3 consecutive meetings with no communication with the board.”

After multiple board members spoke in the public portion of the meeting a vote was taken to remove Star Poole from her position as a Board member.

The vote to remove Poole was nearly unanimous with the exception of Mrs. Barbara Reeves, Vice President who voted against removing her.

Those WASD school board members who voted to remove Poole were; Ms. Lori Baer, President, Mrs. Cody Derr, Mrs. Michelle Deavor, Mr. Patrick Dixon, Mrs. Jennifer Lake, Mr. Jamie Sanders and Mr. Adam Welteroth.

Ms. Star Poole, by state law was not permitted to cast a vote.

Once voted off the board, Ms. Lori Baer, President, asked WASD Solicitor if indeed Ms. Poole needed to leave since she was no longer a member of the board?

Holland concurred and Baer then asked Poole to leave the stage.

At which time Poole exited stage left.

At this writing Star Poole is still listed as a “Board Member” on the WASD website. Under drop down links both “Education” and “Positions” remain blank.

In a break from previous precedent, due process for the tax paying public and board policy; Ms. Lori Baer, President, undertook an effort to name Scott Williams who garnered the sixth highest vote tally in the November 2021 election.

Mr. Jamie Sanders made a motion which was seconded to contact Williams to see his interest level to fill the now vacated seat left by Star Poole.

Currently, Lycoming County District Attorney, Ryan Gardner has a petition and complaint signed by at least 10-voters in the WASD to hold the entire board accountable for “malfeasance in office” and “dereliction of duty.”

According to public comments made Tuesday evening and memorialized on video by TalkWilliamsport.com both Mrs. Barbara Reeves, Vice President and Mr. Jamie Sanders ; they acknowledged “the board was complicit in allowing the (Poole) situation (repeated absences with no repercussions).”

When reached this evening, Lycoming County District Attorney, Ryan Gardner declined comment for this story.

On Friday afternoon Krista Rogers, Lycoming County Controller through her legal counsel filed a lawsuit against the Lycoming County Commissioners in order to return function and authority of County fiscal operations to her office.

The following is the press release from Krista Rogers, Lycoming County Controller outlining the case.

“In April 2021, the Lycoming County Commissioners illegally transferred four positions out of the Controller’s office moving them into their office of Budget and Finance.

In doing so, the Commissioners unilaterally transferred the duties of the County Controller enumerated in Pennsylvania law to their own office of Budget and Finance eliminating Lycoming County taxpayers independent fiscal oversight of their spending by the elected Controller.

Adding further insult to the taxpayers, the Commissioners filed a lawsuit and an emergency injunction, and contempt charges, against the Controller for refusing to honor the Commissioners unlawful transactions.

The case was assigned to Sr. Judge Leete and after several evidentiary hearings, and briefs of law filed on both sides, the judge ruled against the Commissioners on all counts.

The Commissioners legal interpretation of Pennsylvania law is an absolute overreach for power, without merit. Lycoming County taxpayers are left with no checks and balances allowing the Commissioners to create a financial system ripe for fraud, theft, and misuse of county tax dollars.

Despite losing in Court, the Commissioners have yet to return payroll, accounts payable and reporting positions to the Controller’s office –WHERETHEY BELONG.

“After repeated attempts made by me and by my attorneys, and after exhausting all my administrative remedies, I have no choice but to file this lawsuit to return the positions and duties to my office”, Rogers said.

Without these critical positions, the Controller is unable to fully perform the fiscal oversight role required of a County Controller i.e., to review, scrutinize, approve, and report on County spending and fiscal transactions on behalf of County taxpayers.

Rogers said, “as of today the Department of Community and Economic Development (DCED) report, a major state financial reporting requirement, has not been filed for 2020 (original due date 7/1/2021), major mistakes have been made on accounts payable and payroll and most financial transactions are being processed unlawfully, and with without my approval”.

The Commissioners actions illegally eliminate a critical separation of county powers that the Pennsylvania legislature wrote into the law outlining the authority and responsibilities of Pennsylvania County Controllers. This separation of powers was put in place to protect the taxpayers of this county.

“I cannot stand by and allow the Commissioners to eliminate checks and balances –fiscal oversight -in Lycoming County government. I am doing everything I can to restore Lycoming County fiscal independent oversight according to Pennsylvania law.” Krista Rogers, Lycoming County Controller stated.Krista Rogers, Controller”

At this writing, there is an opening for an accountant (open since July 2021) and a financial technician (open since early April 2021), both positions are in the Office of Budget and Finance.
